Independent Person

South Kesteven District Council (‘the Council’) is required under section 27 of the Localism Act 2011 to appoint an Independent Person to assist the Council in promoting and maintaining high standards of conduct by district councillors and co-opted members of the Council, and by Town/Parish Councillors of Town/Parish Councils within the District.


Under the Council’s local process for the consideration of code of conduct complaints, the views of the Independent Person may be sought by the Monitoring Officer on receipt of an allegation against a Councillor.  Those views must however be sought and taken into account by the Monitoring Officer on whether an investigation should be carried out and on making the decision itself.


The Independent Person’s views may also be sought by the person complained against. The Independent Person may also be consulted by the council on other ‘standards of conduct’ matters.


Finally, the Independent Person will be available to advise the Council as part of a Panel prior to any vote on whether to dismiss the Council’s Head of Paid Service, the Monitoring Officer or the Chief Finance Officer (“Protected Officers) This is a statutory requirement under The Local Authorities (Standing Orders) (England) (Amendment) Regulations 2015,

Although the role is voluntary, an allowance of £1,000 per annum is paid.
